Filing a DMCA Notice

Counter-Notice Procedure

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notice with our Copyright Agent. The counter-notice must include the following information:

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
Your contact information, including your name, address, telephone number, and email address.
A statement by you, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
Your physical or electronic signature (typing your full name will suffice as an electronic signature).

Upon receiving a valid counter-notice, we will promptly forward it to the party who submitted the original DMCA notice. If that party does not file a court action against you within 10 business days, we will remove the takedown restriction and restore the material.

Repeat Infringers

OnlyLust reserves the right to terminate, in appropriate circumstances, users who are repeat infringers. If a user’s account has been the subject of multiple DMCA notices, we may take steps to suspend or terminate their account.

Changes to This Policy

We reserve the right to modify this DMCA Notice & Takedown Policy at any time. Changes and clarifications will take effect immediately upon their posting on the website. If we make significant changes to this policy, we will notify you here that it has been updated.
